Frequently asked questions
It’s natural to have questions when considering mediation, especially during challenging times. Below, we've compiled answers to the most common queries we receive. Our goal is to provide clarity and reassurance, helping you feel more confident about the mediation process and how Accord Mediation can assist you.
How do I start mediation?
The first step is a 20-minute individual consultation. This initial conversation gives the mediator an opportunity to explain how mediation works and to assess whether mediation is suitable for your situation.
Do both parties attend the first meeting together?
No. Initial consultations and any intake sessions are always conducted individually. Joint mediation sessions take place only after all parties have been seen separately and there is a mutual agreement to proceed with mediation.
Is mediation confidential?
Yes, confidentiality is a cornerstone of mediation at Accord Mediation, providing a safe and private space for discussions. The mediation process is conducted in accordance with the Mediation Act 2017 and in line with the ethical standards and Code of Ethics of the Mediation Institute of Ireland (MII), including strict principles of confidentiality.
How will I know if mediation is progressing?
Progress in mediation is not always immediate agreement. It often begins with clearer communication, a better understanding of concerns, and more structured discussion. Each session builds toward practical solutions, and even when challenges arise, working through them constructively can be an important step toward resolution.
What happens if mediation is not suitable?
If mediation is deemed unsuitable during the initial consultation, the mediator will explain why and may suggest alternative options or resources that could better suit your needs.
How long does mediation take?
The duration of mediation varies depending on the complexity of the issues and the willingness off all parties to engage. Some disputes can be resolved in a few sessions, while others may require more time. We work at a pace that suits everyone involved.
Do agreements reached in mediation automatically legally binding?
The agreements reached in mediation are not automatically legally binding. However, once an agreement is drafted, finalised and signed, we encorage our clients to seek independent legal advice to make it legally enforceable, if appropriate.
Is mediation couples counselling?
No, mediation is distinct from counselling. While both involve communication, mediation focuses on resolving specific disputes and reaching practical, forward-looking agreements, not on therapeutic relationship advice or exploring emotional issues.
Is mediation faster and less costly than going to court?
Yes, mediation is generally faster and less costly than traditional court proceedings. It offers a more controlled, private, and less adversarial path to resolution, empowering you to make your own decisions.
What can be resolved in family (separating couples / divorce)?
Family mediation can resolve a wide range of issues including parenting arrangements (custody, access, holidays), financial separation, property division, and developing effective communication strategies for co-parenting.
How can family mediation help parents and children during separation?
Family mediation supports parents in focusing on practical, child-centred solutions during separation or divorce. By reducing conflict and encouraging cooperative discussion, mediation can help minimise the stress children may experience during family change, while keeping the focus firmly on their needs and wellbeing.
How much does mediation cost?
Fee details are provided in writing after the initial consultation, once mediation is considered suitable and tailored to the specific circumstances of the case.
What's the first step like, and what should I expect to happen?
The mediation process begins with a 20-minute individual consultation to explain how mediation works and assess suitability. If appropriate, next steps and documentation are provided in writing before any joint session is arranged.
